The contract for using The Hospitality Dude, the Club and pay-as-you-go services.

1. About these terms

These terms form an agreement between you and The Hospitality Dude. By creating an account, buying Club access, requesting paid work or using member features, you agree to them. You must be at least 18 and able to enter a binding agreement. Business users confirm they have authority to act for the business named.

2. Free access and £4.99 Club

  • Free areas, previews and tools may change or be withdrawn and do not guarantee continuous availability.
  • The Hospitality Dude Club costs £4.99 per month unless a clearly displayed promotional price applies. The price, billing frequency, included features and renewal terms must be shown before you commit.
  • Club access is personal to the account holder and may not be resold, shared outside the permitted business team or used to copy the library.
  • The Club renews monthly until cancelled. You may cancel through the stated account/payment route or by contacting memberships@thehospitalitydude.com. Cancellation stops future renewals; access normally continues to the end of the paid period.
  • We will give clear notice of a price increase or material reduction in paid benefits and explain when it takes effect and how to cancel.

3. Cooling-off and refunds

Consumers normally have a 14-day cancellation right for a distance contract. If you ask for paid digital content or services to start during that period, we will obtain any consent and acknowledgement required by law. Where the law permits, you may have to pay a proportionate amount for services already supplied or may lose the cancellation right for fully supplied digital content after the required express consent and acknowledgement. Nothing here removes statutory rights.

  • Duplicate or unauthorised payments will be investigated and refunded where verified.
  • Pay-as-you-go work is refundable before work starts unless stated otherwise; after work starts, any refund reflects work properly completed and non-recoverable agreed costs, subject to consumer law.
  • Custom or personalised goods/services may have different cancellation rules, which will be stated before order.
  • To cancel or raise a payment issue, contact memberships@thehospitalitydude.com with the account email and transaction reference—never bank credentials.

4. One-to-one and bespoke work

Consultations, menu engineering, HR support, licensing support, reviews and other intensive work are separate pay-as-you-go services. Scope, price, timing, assumptions and deliverables must be agreed in writing before paid work starts. Missed appointments, rescheduling, third-party costs and reliance limits may be covered by the service-specific quotation, which prevails for that work if it expressly says so.

5. Advice boundary

Content, tools, community posts and AI responses provide general operational information, not guaranteed professional advice. They do not replace a solicitor, accountant, regulated financial adviser, medical professional, competent food-safety adviser, licensing authority or other qualified adviser where case-specific advice is required. You remain responsible for decisions, source data, legal deadlines, allergens, employment action, filings, contracts and regulatory compliance.

6. Acceptable use

  • Do not break the law; infringe intellectual property, privacy or confidentiality; impersonate others; scrape or harvest users; probe security; spread malware; automate abusive traffic; evade access controls; or use the service to train a competing model or database without written permission.
  • Do not post threats, harassment, hate, pornography, doxxing, defamatory allegations, confidential workplace material, fake reviews, concealed incentives or advertising outside permitted areas.
  • Do not gamble or offer money, prizes or anything redeemable for value through the Games Room. Dude Chips, points and scores have no cash value.
  • Keep login credentials secure and tell us promptly about unauthorised access.

7. Community content and moderation

You retain ownership of content you submit, but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it only as needed to operate, promote and improve the service. You confirm you have the necessary rights. We may remove, restrict or preserve content, suspend features or terminate accounts where reasonably necessary for safety, law, enforcement or platform integrity. See the Community Rules for detail.

8. Suppliers, experts and third parties

Paid listings and sponsored placements are labelled. Payment does not guarantee recommendation, ranking, exclusivity, leads or results. Suppliers and experts remain responsible for their own products, advice, pricing, contracts, insurance, credentials and service. Unless expressly stated in writing, we are an introducer rather than the supplier’s agent or a party to the customer-supplier contract.

9. Intellectual property

The Hospitality Dude name, Dude artwork, blue-eyed character, HD branding, site design, original copy, tools, templates and software are owned by or licensed to us. You may use downloaded member materials internally for the purchasing member’s hospitality business, but may not resell, publish, share publicly or remove notices without written permission.

10. Availability and liability

We use reasonable care and skill in paid services and do not exclude liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or statutory consumer rights. Subject to those protections, we are not responsible for losses caused by inaccurate user data, independent third parties, unauthorised account use, or decisions made contrary to clear warnings. For business users only, indirect or consequential loss and loss of profit, revenue, opportunity or goodwill are excluded to the extent lawful; our aggregate liability is limited to the greater of £100 and the fees paid for the affected service in the previous 12 months. Consumer liability remains subject to applicable law and reasonable foreseeability.

11. Suspension, termination and changes

You may stop using free access or close your account. We may suspend or terminate access for serious or repeated breach, non-payment, security risk, unlawful conduct or material harm, normally with notice where reasonable. Terms may change for legal, security or product reasons; material changes affecting paid users will be communicated in advance where practicable.

12. Law and disputes

These terms are governed by the law of England and Wales. Consumers keep any mandatory right to bring a claim in the courts of the part of the UK where they live. Please contact support first so we can try to resolve the issue. If a clause is unenforceable, the rest remains effective. Delay in enforcement is not a waiver.
